GENERAL PROVISIONS

(Valid: 1.1.2015 – 19.12.2016)

These Terms and Conditions (“Terms”) govern the use of the online platform Locagrapher.com (also “Platform”). These Terms apply both to clients (“Users”) and to photographers. There is an additional document (“Terms and Conditions for Photographers”) that needs to be agreed by the Photographer before the photo shoot.

– “User” means client who is interested in photo session

– “Photographer” means independent provider of photography services

localgrapher.wpengine.com is an online platform where Users plan and arrange photo sessions with Photographers. Photographers offer their photography services as Bronze, Silver or Gold packages which can be booked by the Users.

Localgrapher.com does not provide any photography services. Photography services are provided by Photographers, who are not employees of Localgrapher.com. Localgrapher.com acts solely as an intermediary between User and the Photographer. The contract for photography services is formed between the Photographer and the User.

Photographer declares that he/she holds all the permissions and authorisations necessary to provide photography services (if such permissions and authorisations are required by the applicable law), alternatively Photographer declares, that he/she is legally allowed to provide photography services on occasional basis (not as a businessperson) if this is allowed by the applicable law.

Localgrapher.com will take over the payment (paid via PayPal) for the photo shoot on behalf of the Photographer. Localgrapher.com keeps previously agreed commission fee from the price paid by User after Localgrapher.com receives photos from the Photographer. The rest of the amount is transferred to photographer’s PayPal account. Localgrapher.com is not responsible for and will not reimburse any additional fees charged to Photographer by PayPal for receiving such payment.

Photographer authorizes Localgrapher.com to issue the tax document (invoice) to the User on behalf of the Photographer. The photographer who is registered businessman is obliged to report his/her VAT ID if such ID was assigned to him/her.

We do not guarantee that photographer that you select for the initiate non-binding booking will be available for your date/time/location of your photo shoot. In such case we will suggest you another Photographer but you are not obliged in any way to book this newly suggested Photographer.

Please note that additional travel fee may apply if you want the photo shoot to happen outside of the city centre (we will always notice you in advance about this).

CANCELLATION POLICY

In case you will not be able to attend the photo shoot please contact us as soon as possible and we will do our best to rearrange the date of photo shoot however we cannot guarantee that Photographer would be free on other date/time.

If photo shoot is cancelled due to Photographer’s fault, we will fully refund you. Please note that we will always try to do our best to reschedule your photo shoot so there will be no need for cancellation fees.

Notification of cancellation from the User:

– More than three days before the scheduled photo shoot: 20% administration fee.

– Less than three days before the scheduled photo shoot: 50% cancellation fee.

– Day before the photo shoot and less: no refund.

PAYMENT POLICY

Localgrapher shows prices in EUR and USD. User could choose whether he/she wants to pay in EUR or USD.

PayPal provides an automatic foreign currency conversion at the time that you pay the booking fee. The amount charged by PayPal may vary according to changes in the foreign exchange rates. We do not have any control over the foreign exchange rates set by banks and bear no responsibility for the foreign exchange conversion rates used by PayPal.

DELIVERY OF PHOTOS

We will deliver your photos via personalised, password-protected, online gallery. The link to this gallery will be send to you via email that you submitted to the booking form. Photographer makes the final selection of the photos (number of photos specified in the selected package). We will deliver your photos no later than 4 business days after your photo shoot.

COPYRIGHT

User has the rights to use all delivered photos for personal and non-commercial use only. User could e.g. print the photos, share with friends etc. Photographer retains copyright for the photos. We will never sublicense your photos. We reserve the right to use the photos for promotional purposes on Localgrapher.com, Localgrapher’s social media profiles, printed materials etc. Photographer could use the photos in the same way as we do. User could inform us anytime that he or she does not agree with such usage and we would never use the photos in such way.

COMPLAINTS POLICY

By booking the service you agree that you are familiar with the style of your chosen Photographer and you agree to receive photos in such style and quality. In case of any problem with the photo shoot please contact Localgrapher.com immediately so we could handle the complaint as soon as possible. We will do our best to solve the issue.

We have no control over vis maior, extraordinary circumstances and weather conditions. Photo shoots could take place in any weather conditions since our Photographers are professionals and could suggest locations where it is possible to shoot in the rain etc. Sometimes rainy photo shoots are even more original, extraordinary and interesting than traditional “sunny days” photo shoots. However we will try to rearrange (with no guarantee) day and time of the photo shoot if there is bad forecast for the day of the photo shoot. Payment is not refundable because of the bad weather.

PRIVACY POLICY

It is our highest priority to protect all the data provided by Users to Localgrapher.com. We would never licence or sub-licence any data collected from customers with regards to usage of Localgrapher.com. By submitting booking form you agree that we will collect your personal data such as name, email, telephone number and other data that you submit to us. Such data will be used solely in connection with handling of your booking, photo shoot and delivery of the photos.

If you choose and tick “Yes, I would like to receive Localgrapher’s newsletter” in the booking form you hereby agree to receive newsletter from Localgrapher.com. This newsletter will be send to email that you provided in booking form. Personal data collected from you will be collected for indefinite period of time. You are entitled to revoke your consent with usage and collecting of your data at any time. In such case we will remove your data from the database immediately.

GOVERNING LAW

These Terms and conditions and the provision of Localgrapher.com services shall be governed by the law of the Czech Republic, Europe. Any dispute arising out of these Terms and conditions and our services shall exclusively be submitted to the competent Czech courts.

Tyto podmínky se vztahují jak na uživatele, tak na fotografy. S fotografy jsou dále odsouhlaseny další detaily spolupráce v samostatném dokumentu.

Přístupem k platformě a jejím používáním vyjadřujete souhlas s těmito všeobecnými obchodními podmínkami, které ustanovují smluvní vztah mezi vámi a localgrapher.com, stejně jako některé aspekty užívání platformy. Pokud s těmito smluvními podmínkami nesouhlasíte, nesmíte platformu používat.

Pro potřeby těchto všeobecných obchodních podmínek (dále jen “VOP”) se rozumí:

– uživatelem klient, který má zájem o fotografické služby

– fotografem nezávislý poskytovatel fotografických služeb

Webová stránka localgrapher.com je technologickou platformou, na které uživatelé domlouvají a plánují fotografická setkání s fotografy. Fotografové nabízejí své služby (fotografování) ve formě bronze package, silver package a golden package (viz specifikace jednotlivých balíčků v záložce „packages“) k objednávce zákazníkem.

Localgrapher.com neposkytuje fotografické služby – tyto služby jsou poskytovány výhradně fotografy, kteří nejsou zaměstnanci Localgrapher.com. Localgrapher.com je zprostředkovatelem mezi uživatelem a fotografem. Smluvní vztah týkající se fotografického setkání vzniká mezi fotografem a uživatelem.

Fotograf prohlašuje, že má příslušná povolení či oprávnění k provádění fotografické činnosti, pokud takové povolení či oprávnění požaduje příslušný právní řád, případně fotograf prohlašuje, že může fotografickou činnost provádět na příležitostné a nepodnikatelské bázi, pokud mu toto příslušný právní řád umožňuje.

Odesláním „booking form“ dochází k nezávazné objednávce a dotazu na dostupnost vybraného fotografa v daném termínu. Další domluva konkrétních detailů fotografování probíhá prostřednictvím emailu. Po domluvení těchto detailů je uživatel vyzván k platbě pomocí služby PayPal. Po obdržení platby je závazně rezervován domluvený termín a čas fotografování s vybraným fotografem.

Platbu prostřednictvím PayPal vám jménem fotografa zprostředkuje Localgrapher.com jako zástupce pro výběr takových plateb. Po dodání fotografií uživateli si Localgrapher.com ponechává s fotografem smluvenou provizi a zbylou částku převádí na účet fotografa pomocí PayPal převodu. Fotograf nese veškeré poplatky, které mu budou účtovány ze strany PayPal za přijmutí této platby.

Fotograf zmocňuje Localgrapher.com k vystavení daňového dokladu. Fotograf, který je registrovaným podnikatelem, je povinen Localgrapher nahlásit své DIČ (VAT ID), pokud mu bylo přiděleno.

Ceny jsou uvedeny v USD a EUR, uživatel může cenu uhradit i v Kč dle aktuálního kurzu ČNB v den platby.

Fotografie budou dodány uživateli do čtyř pracovních dnů ode dne fotografování a to prostřednictvím odesláním odkazu na online galerii. Fotografie budou dostupné ke stažení a použití ve formátu „.jpg“. Uživatel prohlašuje, že se seznámil se stylem a kvalitou fotografií vybraného fotografa.

Localgrapher.com si vyhrazuje právo užít fotografie k propagačním účelům (příkladmo použití na webu localgrapher.com, profilech na sociálních sítích, tiskových materiálech apod.). Uživatel může kdykoliv vyslovit nesouhlas s takovým užitím a fotografie již nebudou dále daným způsobem využívány.

Uživateli se uděluje časově neomezená licence k osobnímu nekomerčnímu použití fotografií (např. tisk pro osobní potřebu, sdílení s přateli apod.) Fotografie nesmí být dále přeprodány, licencovány, nebo sublicencovány.

Komunikaci lze provádět v českém nebo anglickém jazyce.

Práva a povinnosti stran se řídí občanským zákoníkem 89/2012 Sb. (dále jen OZ) a dalšími příslušnými zákony. Spotřebitel může od smlouvy odstoupit ve lhůtě 14ti dnů od jejího uzavření (dle § 1829 OZ). Odstoupí-li spotřebitel od smlouvy, zašle nebo předá podnikateli bez zbytečného odkladu, nejpozději do čtrnácti dnů od odstoupení od smlouvy, zboží, které od něho obdržel. Byla-li spotřebiteli již poskytnuta služba, není z toho podnikateli ničeho povinen s výjimkou ustanovení § 1834 OZ. Spotřebitel nemůže takto odstoupit od smlouvy o poskytování služeb (služba zprostředkovaná zprostředkovatelem localgrapher.com) jestliže tato služba byla splněna s předchozím výslovným souhlasem zákazníka před uplynutím lhůty pro odstoupení od smlouvy. Localgrapher tímto výslovně sděluje, že v takovémto případě nemá zákazník právo na odstoupení od smlouvy, viz §1837 OZ. Odstoupí-li spotřebitel od smlouvy, vrátí mu podnikatel bez zbytečného odkladu, nejpozději do čtrnácti dnů od odstoupení od smlouvy, všechny peněžní prostředky včetně nákladů na dodání, které od něho na základě smlouvy přijal, stejným způsobem. Podnikatel vrátí spotřebiteli přijaté peněžní prostředky jiným způsobem jen tehdy, pokud s tím spotřebitel souhlasil a pokud mu tím nevzniknou další náklady. O právech z vadného plnění platí obdobně ustanovení o kupní smlouvě (viz příslušná ustanovení OZ). Zákazník však není oprávněn požadovat provedení náhradního díla, jestliže předmět díla vzhledem k jeho povaze nelze vrátit nebo předat zhotoviteli. Zákazník je oprávněn uplatnit vady díla bezprostředně po jeho dodání (umožnění přístupu do online galerie s fotkami). K mimosoudnímu řešení spotřebitelských sporů z kupní smlouvy je příslušná Česká obchodní inspekce, www.coi.cz. Platformu pro řešení sporů on-line nacházející se na internetové adrese http://ec.europa.eu/consumers/odr je možné využít při řešení sporů mezi prodávajícím a kupujícím z kupní smlouvy.

Ochrana osobních údajů zákazníka je poskytována zákonem č. 101/2000 Sb., o ochraně osobních údajů. Zákazník odesláním “booking form” souhlasí se zpracováním těchto svých osobních údajů: jméno a příjmení, emailová adresa a telefonní kontakt (dále společně vše jen jako “osobní údaje”). Zákazník souhlasí se zpracováním osobních údajů pro účely domlouvání a plánování fotografování a za účelem kontaktování uživatele v souvislosti s již naplánovaným fotografováním. V případě, že zákazník označil při odeslání “booking form” možnost “Yes, I would like to receive Localgrapher’s newsletter”, souhlasí touto volbou také s využitím jeho kontaktních údajů k zasílání obchodních sdělení. Vaše osobní údaje nikdy neposkytneme třetí straně. Osobní údaje budou zpracovány po dobu neurčitou. Osobní údaje budou zpracovány v elektronické podobě automatizovaným způsobem nebo v tištěné podobě neautomatizovaným způsobem. Na žádost uživatele budou jeho osobní údaje z databáze bez zbytečného odkladu odstraněny. Souhlas se zpracováním osobních údajů může uživatel kdykoliv odvolat.

Tyto VOP jsou platné a účinné od 1. 1. 2015.

If you don’t like your online gallery (with the number of photos specified in the booked package) once we deliver it, you can contact us within 7 days and claim your money back. Your full refund will be processed within 5 days. Localgrapher.com is not responsible for and will not reimburse any additional fees charged to the client by PayPal for receiving above specified refund. This money back guarantee is applicable to all the inquiries that we’ve received starting from 16th April 2017. Money back guarantee applies to consumer photo sessions only, it’s not applicable to B2B contracts.

These Terms and Conditions (“Terms”) govern the use of the online platform Locagrapher.com (also “Platform”). These Terms apply both to clients (also “Users”) and to photographers. There is an additional document (“Terms and Conditions for Photographers”) that needs to be agreed by the Photographer before the photo shoot.

Your access and use of the Platform constitutes your agreement to be bound by these Terms, which establishes a contractual relationship between you and Localgrapher.com. If you do not agree to these Terms, you may not access or use the Platform.
– “User” means client who is interested in photo session
– “Photographer” means independent provider of photography services

www.localgrapher.com is an online platform where Users plan and arrange photo sessions with Photographers. Photographers offer their photography services as Bronze, Silver or Gold packages which can be booked by the Users.

Localgrapher.com does not provide any photography services. Photography services are provided by Photographers, who are not employees of Localgrapher.com. Localgrapher.com acts solely as a Platform that offers the Photographer the possibility to use this online platform to market his/her services. The contract for photography services is formed between the Photographer and the User.
Photographer declares that he/she holds all the permissions and authorisations necessary to provide photography services (if such permissions and authorisations are required by the applicable law), alternatively Photographer declares, that he/she is legally allowed to provide photography services on occasional basis (not as a businessperson) if this is allowed by the applicable law.

The non-binding booking and inquiry is made by sending the “booking form” on the profile of Photographer. All other details regarding the photo shoot are then arranged and specified via emails. User is invited to pay via payment gateway after all the details of the photo shoot are cleared. The binding booking is made after receiving the payment from User.
Localgrapher.com will take over the payment (paid via payment gateway) for the photo shoot on behalf of the Photographer. Localgrapher.com keeps previously agreed commission fee from the price paid by User after Localgrapher.com receives photos from the Photographer. The rest of the amount is transferred (payout) to photographer’s PayPal account. Localgrapher.com is not responsible for and will not reimburse any additional fees charged to Photographer by PayPal for receiving such payment.

Photographer will provide Localgrapher with his/her business name, business ID, business address, and VAT number (if he/she has one). Localgrapher will issue invoice for using the platform to the Photographer after the photo shoot and the Bill that will be delivered to the Photographer and to the User. Invoice for providing photography service will be issued to the User by the Photographer.
The agreed payout amount of photographers who fall under categories listed below will be reduced of the applicable VAT.
– Photographers based in the European Union who are not registered business persons. Payout in such case will be lowed by the VAT rate applicable in their country.
– Photographers based in the Czech republic (both business and non-business). Payout in such case will be lowered by the 21% VAT (DPH) that is applicable in the Czech republic
We do not guarantee that photographer that you select for the initiate non-binding booking will be available for your date/time/location of your photo shoot. In such case we will suggest you another Photographer but you are not obliged in any way to book this newly suggested Photographer.
Please note that additional travel fee may apply if you want the photo shoot to happen outside of the city centre (we will always notice you in advance about this). Additional ravel fee is also applicable to some locations from our list of destinations. The User is always informed about such travel fee before booking the photographer.

DELIVERY OF PHOTOS

Photographer makes the final selection of the photos (number of photos specified in the selected package). We will deliver your photos no later than 4 business days (according to Czech calendar) after your photo shoot. RAW files are never delivered to the client.
If there are more great photos than number specified in the package that you purchased, then we’ll deliver preview watermarked gallery with all the good photos to the User. User then makes his/her selection of photos specified in the package. The User can select more photos than specified in the package. Each additional photo costs 9 USD. The user is will pay for additional photos once he/she finalizes the selection. Complete selection of photos is then delivered to the client no later than within 2 business days (according to Czech calendar).

If you don’t like your previews in the watermarked gallery you can contact us within 7 days after the delivery of this preview gallery and claim your money back. This can be only done before the delivery of your selection of un-watermarked photos. You can’t claim money back guarantee once your selection of photos is delivered.
If there’s no preview gallery and there’s delivery of the number of photos specified in the purchased package only, you can claim your money back within the 7 days period after delivery of these photos to you.
In both cases, your full refund will be processed within 5 days. This money back guarantee is applicable to all the inquiries that we’ve received starting from 16th April 2017. Money back guarantee applies to consumer photo sessions only and it applies to our standard packages only (Bronze, Silver and Gold package as specified here: https://www.localgrapher.com/pricing/). This money back guarantee is not applicable to B2B contracts.

Webová stránka localgrapher.com je technologickou platformou, na které uživatelé domlouvají a plánují fotografická setkání s fotografy. Fotografové nabízejí své služby (fotografování) ve formě bronze package, silver package a golden package (viz specifikace jednotlivých balíčků v záložce „packages“) k objednávce zákazníkem.
Localgrapher.com neposkytuje fotografické služby – tyto služby jsou poskytovány výhradně fotografy, kteří nejsou zaměstnanci Localgrapher.com. Localgrapher.com vystupuje výhradně jako technologická platforma na které je fotografovi poskytován prostor k prezentaci jeho služeb. Smluvní vztah týkající se fotografického setkání vzniká mezi fotografem a uživatelem.
Fotograf prohlašuje, že má příslušná povolení či oprávnění k provádění fotografické činnosti, pokud takové povolení či oprávnění požaduje příslušný právní řád, případně fotograf prohlašuje, že může fotografickou činnost provádět na příležitostné a nepodnikatelské bázi, pokud mu toto příslušný právní řád umožňuje.
Odesláním „booking form“ dochází k nezávazné objednávce a dotazu na dostupnost vybraného fotografa v daném termínu. Další domluva konkrétních detailů fotografování probíhá prostřednictvím emailu. Po domluvení těchto detailů je uživatel vyzván k platbě pomocí platební brány. Po obdržení platby je závazně rezervován domluvený termín a čas fotografování s vybraným fotografem.
Platbu prostřednictvím platební brány klientovi jménem fotografa zprostředkuje Localgrapher.com jako zástupce pro výběr takových plateb. Po dodání fotografií uživateli si Localgrapher.com ponechává s fotografem smluvenou částku a zbylou částku převádí na účet fotografa pomocí PayPal převodu. Fotograf nese veškeré poplatky, které mu budou účtovány ze strany PayPal za přijmutí této platby.
Fotograf poskytne Localgrapher název firmy, IČO, adresu a DIČ. Localgrapher vystaví po fotografování fotografovi fakturu na smluvenou částku za využití technologické platformy, vyúčtování bude zasláno jak fotografovi, tak klientovi. Faktura za fotografování bude vystavena klientovi přímo fotografem.
Fotografové (podnikatelé i nepodnikatelé) registrovaní v ČR: částka vyplacená za fotografování bude ponížena o českou sazbu DPH.
Fotografové (nepodnikatelé) z EU: částka vyplacená za fotografování bude ponížena o sazbu DPH dané země.
Ceny jsou uvedeny v USD (americký dolar).
Fotografie budou dodány uživateli do čtyř pracovních dnů ode dne fotografování a to prostřednictvím odesláním odkazu na online galerii. Fotografie budou dostupné ke stažení a použití ve formátu „.jpg“. Uživatel prohlašuje, že se seznámil se stylem a kvalitou fotografií vybraného fotografa.
Localgrapher.com si vyhrazuje právo užít fotografie k propagačním účelům (příkladmo použití na webu localgrapher.com, profilech na sociálních sítích, tiskových materiálech apod.). Uživatel může kdykoliv vyslovit nesouhlas s takovým užitím a fotografie již nebudou dále daným způsobem využívány.
Uživateli se uděluje časově neomezená licence k osobnímu nekomerčnímu použití fotografií (např. tisk pro osobní potřebu, sdílení s přateli apod.) Fotografie nesmí být dále přeprodány, licencovány, nebo sublicencovány.
Komunikaci lze provádět v českém nebo anglickém jazyce.

Práva a povinnosti stran se řídí občanským zákoníkem 89/2012 Sb. (dále jen OZ) a dalšími příslušnými zákony. Spotřebitel může od smlouvy odstoupit ve lhůtě 14ti dnů od jejího uzavření (dle § 1829 OZ). Odstoupí-li spotřebitel od smlouvy, zašle nebo předá podnikateli bez zbytečného odkladu, nejpozději do čtrnácti dnů od odstoupení od smlouvy, zboží, které od něho obdržel. Byla-li spotřebiteli již poskytnuta služba, není z toho podnikateli ničeho povinen s výjimkou ustanovení § 1834 OZ. Spotřebitel nemůže takto odstoupit od smlouvy o poskytování služeb (služba zprostředkovaná zprostředkovatelem localgrapher.com) jestliže tato služba byla splněna s předchozím výslovným souhlasem zákazníka před uplynutím lhůty pro odstoupení od smlouvy. Localgrapher tímto výslovně sděluje, že v takovémto případě nemá zákazník právo na odstoupení od smlouvy, viz §1837 OZ. Odstoupí-li spotřebitel od smlouvy, vrátí mu podnikatel bez zbytečného odkladu, nejpozději do čtrnácti dnů od odstoupení od smlouvy, všechny peněžní prostředky včetně nákladů na dodání, které od něho na základě smlouvy přijal, stejným způsobem. Podnikatel vrátí spotřebiteli přijaté peněžní prostředky jiným způsobem jen tehdy, pokud s tím spotřebitel souhlasil a pokud mu tím nevzniknou další náklady. O právech z vadného plnění platí obdobně ustanovení o kupní smlouvě (viz příslušná ustanovení OZ). Zákazník však není oprávněn požadovat provedení náhradního díla, jestliže předmět díla vzhledem k jeho povaze nelze vrátit nebo předat zhotoviteli. Zákazník je oprávněn uplatnit vady díla bezprostředně po jeho dodání (umožnění přístupu do online galerie s fotkami). K mimosoudnímu řešení spotřebitelských sporů z kupní smlouvy je příslušná Česká obchodní inspekce, www.coi.cz. Platformu pro řešení sporů on-line nacházející se na internetové adrese http://ec.europa.eu/consumers/odr je možné využít při řešení sporů mezi prodávajícím a kupujícím z kupní smlouvy.
Ochrana osobních údajů zákazníka je poskytována zákonem č. 101/2000 Sb., o ochraně osobních údajů. Zákazník odesláním “booking form” souhlasí se zpracováním těchto svých osobních údajů: jméno a příjmení, emailová adresa a telefonní kontakt (dále společně vše jen jako “osobní údaje”). Zákazník souhlasí se zpracováním osobních údajů pro účely domlouvání a plánování fotografování a za účelem kontaktování uživatele v souvislosti s již naplánovaným fotografováním. V případě, že zákazník označil při odeslání “booking form” možnost “Yes, I would like to receive Localgrapher’s newsletter”, souhlasí touto volbou také s využitím jeho kontaktních údajů k zasílání obchodních sdělení. Vaše osobní údaje nikdy neposkytneme třetí straně. Osobní údaje budou zpracovány po dobu neurčitou. Osobní údaje budou zpracovány v elektronické podobě automatizovaným způsobem nebo v tištěné podobě neautomatizovaným způsobem. Na žádost uživatele budou jeho osobní údaje z databáze bez zbytečného odkladu odstraněny. Souhlas se zpracováním osobních údajů může uživatel kdykoliv odvolat.
Tyto VOP jsou platné a účinné pro všechna potvrzená fotografování počínaje 10. října 2017 (včetně).
